A comprehensive guide to terminology used in property fractional ownership, trust-based accommodation, and the MyProperty platform.
A
Add-ons
HolidayAdditional services that can be added to bookings using Holiday Points. Options include Gourmet Meat Packs (20 points/kg), Premium Drinks Selection (15 points/kg), and Garden Experience Packages (8 points/package).
Administration Fee
FinancialA 2.5% fee added to Ownership purchases to cover administrative and processing costs. This is the only fee - there are no ongoing annual membership fees.
Annual Refresh
HolidayThe yearly reset of Holiday Points occurring on January 1st. All unused points from the previous year expire, and new points are allocated based on current Ownership holdings.
Approval Threshold
VotingThe percentage of votes required for a proposal to pass. Thresholds vary by category: 51% for operational changes, 60% for significant matters, 75% for major decisions.
Availability
BookingThe status of a property unit showing whether it can be booked for specific dates. Availability is managed in real-time and is visible during the booking process.
B
Beneficial Interest
OwnershipThe right to benefit from property held in trust without holding direct legal title. As an Ownership holder, you have beneficial interest in the trust's properties, entitling you to usage rights and a share of the trust's assets.
Beneficiary
OwnershipA person who holds beneficial interest in a trust. All Ownership holders are beneficiaries of the MyProperty Lifestyle Trust with rights defined by the trust deed.
Booking
BookingA confirmed reservation to stay at a trust property. Bookings require available Holiday Points and are subject to availability. Minimum stay is 2 nights, maximum is 21 nights.

Cancellation Policy
BookingThe rules governing refunds when bookings are cancelled. Refunds are tiered: 30+ days (100%), 21-29 days (75%), 14-20 days (50%), 7-13 days (25%), <7 days (0%).
Cession
OwnershipThe legal transfer of rights from one party to another. When Ownership is sold on the marketplace, cession transfers the beneficial interest from seller to buyer.
Check-in / Check-out
BookingThe process of arriving at and departing from a property. Standard check-in is typically from 2:00 PM and check-out by 10:00 AM, though specific times may vary by property.
CISCA
LegalCollective Investment Schemes Control Act - South African legislation regulating investment schemes. The trust is designed to not constitute a CIS as it offers lifestyle benefits rather than investment returns.
Classical Fractional Ownership
IndustryTraditional fractional ownership where multiple parties hold direct deed shares (e.g., 1/8th) of a single property. Involves complex co-ownership agreements and fixed usage schedules. MyProperty's trust model offers more flexibility.
Co-ownership
IndustryJoint ownership of property by multiple parties. In classical fractional ownership, co-owners share a deed; in trust-based ownership, the trust holds title while members have beneficial interests.
Collective Investment Scheme (CIS)
LegalA regulated arrangement where investors pool money for investment returns. MyProperty Trust is NOT a CIS - it provides lifestyle accommodation benefits without investment return expectations.

Fiduciary Duty
OwnershipThe legal obligation of trustees to act in the best interests of beneficiaries, with loyalty, prudence, and care. This includes managing trust assets responsibly and avoiding conflicts of interest.
Financial Product
LegalA product regulated by financial services authorities, typically involving investment returns. MyProperty Trust explicitly is NOT a financial product - it's a lifestyle accommodation membership.
FSCA
LegalFinancial Sector Conduct Authority - South Africa's financial services regulator. MyProperty Trust is structured as a lifestyle product (not a financial product) to operate outside FSCA regulation.

Gold Tier
MembershipThe third membership tier for holders of 5-9 Ownership's. Includes all Silver benefits plus additional privileges and recognition within the member community.

Holiday Points
HolidayThe accommodation currency used to book stays at MyProperty Trust properties. Each Ownership generates 550 Holiday Points annually. Points are used to pay for accommodation, with different unit types costing different point amounts per night.
Holiday Points Marketplace
MarketplaceThe section of the marketplace where members can list and purchase Holiday Points. Useful for selling surplus points before expiry or buying additional points for extended stays.

Listing
MarketplaceAn offer to sell Holiday Points or Ownership on the marketplace. Sellers set their own prices and can include descriptions and expiry dates for their listings.
M
Marketplace
MarketplaceThe platform where members can buy and sell Holiday Points and Ownership. The marketplace facilitates peer-to-peer transactions between members in a secure environment.
Membership Tier
MembershipA classification system based on the number of Ownership's held. Tiers include Standard (1), Silver (2-4), Gold (5-9), and Platinum (10+). Higher tiers may receive additional benefits and priority access.
O
Ownership
OwnershipA unit of beneficial interest in the MyProperty Lifestyle Trust. Each Ownership entitles the holder to 550 Holiday Points annually, voting rights, and a proportional share of the trust's property portfolio. Ownership can be bought, sold, or transferred through the marketplace.
Ownership Marketplace
MarketplaceThe section of the marketplace where members can list and purchase Ownership. Enables exit from the trust or expansion of holdings through peer-to-peer transactions.
P
Platinum Tier
MembershipThe highest membership tier for holders of 10+ Ownership's. Includes all Gold benefits plus maximum privileges, priority access, and distinguished recognition.
Point Allocation
HolidayThe annual distribution of Holiday Points to Ownership holders. Each Ownership receives 550 points on January 1st each year. The allocation is automatic and based on the number of Ownership's held.
Point Expiry
HolidayThe date when unused Holiday Points become invalid. All points expire on December 31st each year. Points cannot be carried forward but can be sold on the marketplace before expiry.
Points Cost
HolidayThe number of Holiday Points required per night for different accommodation types. 2-Bedroom Suites cost 30 points/night, 3-Bedroom Suites cost 40 points/night, and Penthouses cost 55 points/night.
Property Fractional Ownership
OwnershipA form of property ownership where multiple parties share beneficial rights to real estate through a structured arrangement. Unlike timeshares, fractional ownership typically includes actual ownership interest in the underlying property or trust assets.
Property Portfolio
BookingThe collection of luxury properties owned and managed by the trust. The portfolio may grow over time through trust decisions approved by member voting.
Proposal
VotingA formal suggestion submitted by members for trust consideration. Proposals require support from members holding at least 10 Ownership's before proceeding to a full vote.
Proposal Categories
VotingThe eight types of proposals members can submit: Property Improvements, Operational Changes, Financial Matters, Amenity Additions, Policy Changes, Sustainability Initiatives, Emergency Measures, and Partnership Proposals.
R
Reactivation
VotingThe process of reopening a failed proposal for another vote. Proposals can be reactivated up to 2 times, allowing proposers to modify and resubmit based on member feedback.
Refund
FinancialThe return of Holiday Points when a booking is cancelled. Refund amounts depend on the cancellation timing relative to the check-in date, following the tiered cancellation policy.
Regulatory Compliance
LegalAdherence to applicable laws and regulations. The trust maintains compliance with South African trust law while being structured to fall outside financial services regulations.

Silver Tier
MembershipThe second membership tier for holders of 2-4 Ownership's. Includes all Standard benefits plus enhanced recognition and potential priority consideration.
Standard Tier
MembershipThe entry-level membership tier for holders of 1 Ownership. Includes full access to all core benefits including Holiday Points, booking rights, marketplace access, and voting rights.
Support Threshold
VotingThe minimum level of member support required for a proposal to proceed to voting. Currently set at 10 Ownership's worth of support from the member community.
T
Timeshare
IndustryA traditional vacation ownership model providing usage rights (typically one fixed week per year) without actual property ownership. Often characterised by escalating fees and poor resale value. Different from MyProperty's flexible points-based ownership model.
Trade
MarketplaceA completed transaction between buyer and seller on the marketplace. Trades involve the transfer of Holiday Points or Ownership in exchange for payment.
Trust
OwnershipA legal arrangement where trustees hold and manage property on behalf of beneficiaries. The MyProperty Lifestyle Trust is a South African trust that owns and manages luxury properties for the benefit of Ownership holders.
Trust Deed
OwnershipThe legal document that establishes a trust, defining its purpose, rules, beneficiary rights, trustee powers and duties, and procedures for administration. The MyProperty Trust Deed governs all aspects of trust operations.
Trustee
OwnershipA person or entity legally responsible for managing trust assets and acting in the best interests of beneficiaries. Trustees have fiduciary duties and are bound by the trust deed and applicable law.
U
Unit Type
BookingThe classification of accommodation options within trust properties. Types include 2-Bedroom Suite, 3-Bedroom Suite, and Penthouse, each with different sizes, amenities, and Holiday Points costs.
Usage Rights
IndustryThe right to use a property without ownership. Timeshares typically only provide usage rights. MyProperty provides usage rights PLUS beneficial ownership through the trust structure.
V
Voting Period
VotingThe timeframe during which members can cast votes on an active proposal. Standard voting periods last 14 days from when a proposal is activated.
Voting Rights
VotingThe entitlement of Ownership holders to vote on trust proposals. Each Ownership equals one vote, giving larger holders proportionally more influence in trust decisions.
